Welcome to ScaleSuite. By accessing or using our website and services, you agree to comply with and be bound by the following Terms and Conditions. If you do not agree to these terms, please do not use our services.

Services Provided

ScaleSuite offers digital marketing services, including but not limited to website design and buildout, search engine optimization (SEO), email infrastructure setup, and Google Business Profile management. All services are subject to these terms, as well as the individual terms outlined in your service agreement.

SMS Terms

By providing your mobile phone number, you consent to receive SMS messages from ScaleSuite LLC related to appointment reminders and updates.

Message Frequency: Message frequency may vary.

Message and Data Rates: Standard message and data rates may apply.

Opting Out: You may opt out of receiving SMS messages at any time by replying “STOP” to any SMS message from us. After opting out, you will receive a confirmation message and we will cease all SMS communication to your number.

Help and Support: Reply “HELP” to any SMS message, or contact our support team at (512) 851-8526.

Privacy Policy for SMS: Your phone number will be handled in accordance with our Privacy Policy, available at https://scalesuite.ai/privacy-policy/. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Payment and Refund Policy

Services are billed on a recurring monthly basis as outlined in your service agreement. All payments are final and non-refundable, except where a specific guarantee is explicitly outlined in your signed contract. In the event a refund is issued under the ScaleSuite Guarantee, it will be the sole and exclusive remedy available. Upon issuance of a refund, the client relinquishes all rights, access, and ownership to assets, content, and deliverables produced by ScaleSuite.

The ScaleSuite Guarantee

ScaleSuite guarantees that your website will rank on the first page of Google in your immediate service locality. If this is not achieved within 180 days of active partnership following your website’s publication, you are eligible for a full refund — no questions asked.

This guarantee applies provided that the client follows ScaleSuite’s recommended SEO protocols and refrains from making unauthorized modifications to the website or marketing platforms. ScaleSuite cannot be held liable for failure to rank where client decisions, non-compliance with recommendations, or third-party interference are contributing factors.

Intellectual Property

All intellectual property rights, copyrights, and associated assets remain under ScaleSuite’s control until all minimum partnership term payments have been received. Upon completion of the minimum term, full rights and ownership are transferred to the client. Any content, photos, or materials provided by the client are assumed to be owned by the client; the client accepts full responsibility for ensuring they hold the rights to any assets they supply.

Data and Security

ScaleSuite performs weekly data backups of client websites for the duration of the active partnership. Upon termination of partnership, responsibility for ongoing backups, security maintenance, and compliance transfers fully to the client. ScaleSuite is not liable for security incidents resulting from the client’s failure to follow recommended security protocols or from changes made without prior consultation.

Accessibility

ScaleSuite designs websites following recognized best practices for accessibility. However, the client is ultimately responsible for ensuring their website meets the requirements of the Americans with Disabilities Act (ADA) and any other applicable accessibility standards. Clients are encouraged to seek independent legal guidance on accessibility compliance.

Limitation of Liability

ScaleSuite is not liable for any indirect, incidental, or consequential damages resulting from the use of our services. Past results do not guarantee future outcomes. Any case studies or performance examples shared are for illustrative purposes only and are not a guarantee of results for future or current partners. Results may vary based on market conditions, client cooperation, and other factors outside of ScaleSuite’s control.

Changes to Terms

We may update these Terms and Conditions at any time. Any modifications to your active service agreement must be made in writing and agreed upon by both parties. Continued use of our services after updates to these general terms constitutes acceptance of the revised version.
